Zohran Mamdani is in \u201cactive conversation\u201d with the city\u2019s legal department over the legality of detaining the Israeli PM<\/strong><\/p>\n

New York Mayor Zohran Mamdani has said he is exploring the legal possibility of arresting Israeli Prime Minister Benjamin Netanyahu when he travels to the city for the UN General Assembly in September.<\/p>\n

The International Criminal Court (ICC) issued an arrest warrant for Netanyahu in November 2024 over alleged war crimes and crimes against humanity in Gaza, including \u201cstarvation as a method of warfare\u201d<\/em> and \u201cother inhumane acts.\u201d<\/em><\/p>\n

Mamdani, who has characterized Israel\u2019s military campaign in Gaza as genocide, vowed during his mayoral campaign last year to arrest Netanyahu if he visited New York City. During an episode of The New York Times\u2019 The Interview podcast that aired on Saturday, the mayor was asked whether he still intended to fulfill that pledge.<\/p>\n

\u201cI believe that Prime Minister Netanyahu belongs in The Hague,\u201d<\/em> he responded, referring to the seat of the ICC, where those accused of major international crimes are tried. \u201cHe\u2019s a war criminal who has been charged by the International Criminal Court, and what you will find is that is an opinion that is held by many, purely because of what his actions have wrought over these last many years.\u201d<\/em><\/p>\n

Accredited representatives of member states are generally granted diplomatic immunity while on official UN visits, but Mamdani said he was in \u201can active conversation\u201d<\/em> with the city\u2019s Law Department about potential legal options.<\/p>\n

\u201cWhatever the law allows me to do in New York City, that\u2019s what we will do,\u201d<\/em> he said. \u201cBut we won\u2019t be writing our own laws to that end.\u201d<\/em><\/p>\n

Israel\u2019s ambassador to the UN, Danny Danon, accused Mamdani of failing to confront a \u201crising wave of antisemitism\u201d<\/em> and instead choosing to \u201cincite hostility\u201d<\/em> against the Jewish state. He confirmed that Netanyahu intends to address the General Assembly during its annual High-Level Week, scheduled for September 22\u201328, saying the mayor\u2019s position \u201cwill not change a thing.\u201d<\/em><\/p>\n

\u201cAnd if anyone should be arrested, it is NYC Mayor Zohran Mamdani,\u201d<\/em> the ambassador added in a post on X.<\/p>\n

Netanyahu said in a recent radio interview that he was not concerned about Mamdani\u2019s threats to detain him, accusing the New York mayor of \u201cchampioning\u201d<\/em> Hamas and hating America.<\/p>\n

Neither the US nor Israel is a party to the ICC, and federal law prohibits state and local authorities from cooperating with requests from the court.
